Terms of Service

All services provided for the clients of Razyr Networks. may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any Canadian federal or provincial law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Razyr Networks from any claims resulting from the use of service which damages the subscriber or any other party. The subscriber is responsible for any libelous and defamatory statements, profane or damaging statements posted and is responsible to monitor and remove any such statements, language or innuendos. Razyr reserves the right to remove any such language without notice to the subscriber.

Prohibited are sites that promote any illegal activity or present content that may be damaging to Razyr Networks’ servers, or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites
  • Libelous or defamatory statements
  • Infringement on the copyright of any other person or entity

It is the client’s responsibility to continually monitor and remove any prohibited content posted to Razyr Networks’ network or servers as a result of the client’s agreement with Razyr Networks.

We do not allow IRC or IRC bots to be operated on our servers.

Cryptocurrency Bots
We do not allow BITCOIN or similar crypto currency bots to be operated on our servers unless specific permission is granted by Razyr Networks Support.

Server Abuse
Any attempt to undermine or cause harm to a server or customer of Razyr Networks is strictly prohibited. As our customer you are responsible for all your accounts. Should you knowingly violate the Terms of Services outlined within, your account will be cancelled without chance of refund. Should you unknowingly violate the Terms of Service, your account will be suspended until such issues are resolved.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.


Services are billed based on fixed fees and metered usage at the end of each month. Legacy customers may choose to stay on annual billing, although no refunds shall be issued for cancelled service. Some services will only be available to customers who are on standard monthly billing cycles.

Metered services such as object storage usage are measured hourly so that customers pay only for consumed resources.

Special arrangements can and will be made for non-profit or charitable organizations, as well as open source projects. Please contact Razyr Networks Sales if you have special billing requirements.

Payment is due in full upon receipt of invoices.

The client is responsible to ensure that all service fees are paid in full and on time.

In the event of non-payment, Razyr Networks shall contact the client by phone or email. If suitable, timely arrangements are not agreed upon, all associated services with the account may be suspended.

Razyr Networks will make every effort to accommodate unforeseen problems in arranging payment, provided the client provides notice in writing by email.

Money back guarantee

We offer a 30 day full money back guarantee for all new hosting services clients. If at any time during the first 30 days of service you are not completely satisfied, you may notify us and we will immediately cancel your service and begin processing the refund of your hosting payment.

Account Deactivation
Any account deactivated due to non-payment will require a reactivation fee of $50.00 prior to reactivation.  Site files and/or backups may not be retained for any account not in good standing.

Limitation of Liability and Indemnity
Razyr Networks shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Razyr Networks ‘ servers going off-line or being unavailable for any reason whatsoever. Furthermore, Razyr Networks shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Razyr Networks ‘ servers. All damages shall be limited to the immediate termination of service.

Other than the express warranties stated on this page, Razyr Networks makes no other representations or warranties hereunder of any kind either express or implied in relation to the services included but not limited to any warranty of merchantability and/or fitness for the any particular purpose. In no event shall Razyr Networks be liable directly or indirectly for any special or consequential or incidental damages included but not limited to a loss of anticipated profits, loss of revenue or loss of data. The subscriber hereby indemnifies and saves harmless Razyr networks from any libelous, defamatory, damaging statements made by the subscriber or any of the subscriber’s clients or persons posting on the site pursuant to the subscriber’s agreement with Razyr Networks.

Violations of these Acceptable Use Policies should be referred to support@razyr.net. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Razyr Networks cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Razyr Networks are resold. Thus, certain equipment, routing, software and programming used by Razyr Networks are not directly owned or written by Razyr Networks. Moreover, Razyr Networks holds no responsibility for the use of our clients’ accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Razyr Networks sees fit.

Account Security
The Internet is an ever increasingly hostile environment in which there can be no absolute guarantees of web site or email account security. Razyr Networks has extensive experience at providing the safest possible environment for you and your web site. While every effort is made to make Razyr Networks the safest hosting option for its clients, no guarantee of security, whether explicit or implied shall be construed from the statements on this web site.

Razyr Networks is not responsible for backing up the data on your web site, dedicated server, email or other hosted service.

Razyr Networks may offer backup services or assist specific customers with backup strategies and implementation from time to time. Such service is provided on a 'best effort' basis.

It is up to the customer to confirm that backups are working correctly on an ongoing basis and contain the expected data.

Deleted Accounts

Razyr Networks is not responsible for maintaining a copy of files, databases or log information for accounts which have been cancelled or otherwise not in good standing.  Such data will be deleted from our servers.  It is the responsibility of the subscriber to back up or otherwise archive hosted services while those services are still active.

Account Activation
By activating your account with Razyr Networks, you agree to all of the policies and disclaimers in this three part document covering acceptable use, privacy and terms of service.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

Server Uptime Guarantee
Razyr Networks guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. Should we fail to deliver this for any given calendar month, you may request a pro-rated refund for the duration of excessive downtime.

Razyr Networks reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.

Acceptable Use

As a provider of web site hosting and other Internet-related services, Razyr Networks offers its customer (also known as “Subscribers”) and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Razyr Networks respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Razyr Networks reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, Razyr Networks has developed an Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement, and is intended as a guide to the customer’s rights and obligations when using Razyr Networks’ services. This AUP will be revised from time to time.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet’s openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Razyr Networks cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because Razyr Networks cannot monitor or censor the Internet, and will not attempt to do so, Razyr Networks cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, libelous, defamatory, offensive or illegal Internet communications.

When subscribers disseminate information from the Internet, they must keep in mind that Razyr Networks does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over Razyr Networks’ network and may reach a large number of people, including both subscribers and non-subscribers of Razyr Networks, subscribers’ postings to the Internet may affect other subscribers and may affect Razyr Networks’ goodwill, business, reputation or operations. For these reasons, subscribers violate Razyr Networks policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:

Sending unsolicited bulk and/or commercial information over the Internet is expressly prohibited under the terms of this agreement. It is not only harmful because of its negative impact on consumer attitudes toward Razyr Networks, but also because it can overload Razyr Networks’ infrastructure and disrupt service to other Razyr Networks’ subscribers. When a complaint is received, Razyr Networks will investigate and shutdown the account that is SPAMing. A $750 fine for intentionally violating this policy will be charged to the person initiating the SPAM. Furthermore Razyr Networks reserves the right to prosecute for this violation. A $1.00 charge will be assessed PER EMAIL sent should Razyr Networks choose to pursue and prosecute. In all cases, Razyr Networks will report to and cooperate fully with law enforcement agencies or third parties who are actively working to shut down the activities of spammers.

It is your responsibility as an end user of Razyr Networks services to ensure the security of your account to prevent unauthorized use. Do not share your account credentials with anyone. A representative of Razyr Networks will NEVER ask for your password. We recommend that you periodically change your password and that you use a password management tool such as LastPass to keep track of all of your online identities.

Canada has new strict federal regulations regarding the use of commercial email.  It is the responsibility of the subscribe to ensure all such regulations are being followed.

Razyr Networks may deploy automated measures to discourage bulk broadcasting of email whether by spammers or for commercial use.  Under the new Canadian regulations, broadcast mail should be managed through a compliant service such as MailChimp or Constant Contact.  Accounts which send high volumes of commercial email over a short period will be temporarily disabled until the subscriber contacts Razyr Support.

Credit Card Processing:
No client of Razyr Networks shall process or store credit card information in any manner which is not in compliance with current Payment Card Industry (PCI) guidelines. Costs incurred by Razyr Networks as the result of preparation for, or actual PCI audit for any specific Razyr Networks customer, shall be born by said customer.

Audio/Video Streaming:
Audio/Video Streaming is not hosting friendly. As such, Razyr Networks does not allow any streaming of audio or video content. Offending accounts will be suspended without noticed or terminated.

Large File Policy:
Razyr Networks is not for file hosting and distribution except by prior arrangement – as such, customers may not host any files larger than 50MB in size that are observed to be available for the sole purpose of download. Such files include but are not limited to .ISO, audio/video files, .EXE files. If you are unsure whether your file is against this policy, please e-mail support@razyr.net.

File Repositories:
Razyr Networks will accommodate sites which require large numbers of files to be stored as part of a web site. If a client needs to store large quantities of archival information, additional storage fees may be levied. We recommend that clients archive information offline to reduce their hosting and backup costs. If clients have large online storage requirements, please discuss these needs with Razyr Support.

Large File and Repository policies exist to ensure fair access to resources to all customers in our shared hosting environments only. This policy do not apply to customers who have dedicated servers with their own storage and bandwidth allocations.

As noted in the Terms of Service, the presence of cryptocurrency bots is prohibited without specific permission from Razyr Networks.

Adult-Oriented Content:
Razyr Networks does not allow adult content and will suspend/terminate any offending account.  Razyr Networks  will report any suspected illegal activity in this regard to the appropriate authorities.

Obscene Speech or Materials:
Using Razyr Networks’ network to advertise, transmit, store, post, display, or otherwise make available obscene speech or material is prohibited.

Defamatory or Abusive Language:
Using or allowing Razyr Networks’ network to be used as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

Forging of Headers:
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks:
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual’s system (often known as “hacking”). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities:
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

Facilitation a Violation of this AUP:
Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

Export Control Violations:
Exporting encryption software over the Internet or otherwise, to points outside Canada and the United States.

Usenet Groups:
Razyr Networks reserves the right not to accept postings from newsgroups where we have knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities:
Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Other Activities:
Engaging in activities, whether lawful or unlawful, that Razyr Networks determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.

As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. Razyr Networks will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Razyr Networks’ policy or applicable law. However, when Razyr Networks becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by Razyr Networks.

Razyr Networks will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. Razyr Networks may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Razyr Networks may disclose information, including, but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Razyr Networks assumes no obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, Razyr Networks may disclose subscriber information or information transmitted over its network where necessary to protect Razyr Networks and others from harm, or where such disclosure is necessary to the proper operation of the system. However, Razyr Networks will never sell information to other services or outside companies.

Finally, Razyr Networks wishes to emphasize that, in agreeing to the Service Agreement, subscribers indemnify Razyr Networks for any violation of the Service Agreement, law or Razyr Networks policy resulting in loss to Razyr Networks or the bringing of any claim against Razyr Networks by any third party. This means that, if Razyr Networks is sued because of a subscriber’s or customer of a subscriber’s activity, the subscriber will be responsible for payment of any damages awarded against Razyr Networks, plus costs and reasonable attorney’s fees.

Any dispute or action in respect of any agreements shall be the exclusive jurisdiction of the Ontario courts sitting in the District of Algoma.

We hope this AUP is helpful in clarifying the obligations of Internet users, including Razyr Networks and its subscribers, as responsible members of the Internet. Any complaints about a subscriber’s violation of this AUP should be sent to support@razyr.net.
